CHENNAI: The Madras high court on Monday morning refused to stall the general council meeting of the AIADMK scheduled to commence at 9.15am.
Justice Krishnan Ramaswamy passed the order on a plea moved by former chief minister O Paneerselvam and others seeking to stall the meeting.
According to OPS, no proper notice has been issued as mandated by the party bylaws and no authorised person has signed the notice for the meeting.
As per the bylaws, only the coordinator and the joint coordinator could jointly call for the meeting but the present notice had been issued by headquarter office bearers, he added.
Opposing the arguments, senior advocate Vijay Narayan representing Edappadi K Palaniswami submitted that it was not a notice but invitation to attend the meeting.
He further added that it would not be appropriate for the high court to stall the meeting after the Supreme Court had categorically said that it could go on.
Senior advocate Guru Krishnakumar representing Paneerselvam contended that AIADMK bylaws did not permit anyone to convene the general council other than the coordinator and the joint coordinator of the party.
Therefore, any action by any other person in that regard would be an intrusion of the rights of the coordinator and the joint coordinator and the same would only be unauthorized, he said.
“As per the party rules, the coordinator and the joint coordinator have a very vital role to play, and effective functions to discharge. The political body of AIADMK is administered by the coordinator and joint coordinator. This authority cannot be usurped by the presidium chairman or any office bearer of the party,” he said.
On Monday morning, tension prevailed at the AIADMK headquarters at Royapettah in Chennai where EPS and OPS supporters clashed. OPS reached the headquarters in the morning while EPS went to Vanagaram in Chennai to attend the GS meeting which will elect him as the general secretary of the party.
